On the extradition of Maja to Hungary

It seems that the Saxon authorities could hardly wait to extradite Maja to queer-hostile and authoritarian Hungary. Several small inquiries to the Saxon State Ministry of the Interior show how the Saxon authorities spared neither expense nor elaborate cooperation in order to extradite Maja and thereby open up new dimensions of repression against anti-fascism in Germany.

The minor interpellations reveal that “the LKA Saxony and the originally responsible Berlin authorities […] have been in close contact […] since the arrest of the person concerned (Maja) as well as in preparation for and during the support operation on June 28, 2024”. This concerns a period of over half a year in which two state authorities worked in close consultation to plan the extradition of an anti-fascist to openly queer-hostile Hungary! For the extradition itself, the LKA provided not only its own forces, but also so-called “external forces” from the Saxony riot police, such as the anti-terror department (!) of the Saxon LKA. Under their direction, Maja was taken to the Austrian border by helicopter in a night and fog operation. It is reasonable to assume that this personnel effort was primarily aimed at extraditing Maja as quickly as possible and without attracting attention, leaving neither room nor time for interruptions or contradictions.

The Ministry of the Interior justifies this costly and certainly financially not insignificant action with hypocritical excuses about alleged “danger aspects”, “expected disruptions to the extradition” and the danger it poses to police officers, judges and public prosecutors. For us, the information provided by the Ministry of the Interior confirms what we had suspected from the outset: Maja’s extradition is by no means legally motivated and justified, but exclusively politically motivated. The whole undertaking was on shaky legal ground right from the start. If the authorities had not carried out the extradition with the described motivation, the unbelievable extent of personnel and official cooperation and at this speed, and *even* simply overlooked the ruling of the supreme federal body, the extradition would have been suspended for at least another few weeks.

As a reminder: After Maja’s lawyers had learned of the positive decision of the Berlin Court of Appeal on the afternoon of June 27, which made Maja’s extradition legally possible, they filed an urgent application with the Federal Constitutional Court for a temporary injunction of this order. This application was granted on 28.08 11:00! This means that the Federal Constitutional Court has prohibited Maja’s extradition to Hungary by German authorities.

However, these suddenly highly motivated and eager authorities, including the Saxon LKA, began kidnapping Maja in the night from June 27 to 28 and handed her over to the Austrian authorities in the early morning at around 06:50, who “handed her over” to their Hungarian colleagues.
The authorities were aware of the urgent application and knew that the outcome of the application was uncertain. They therefore deliberately decided to ignore it and deport Maja in the middle of the night.
Thus, the repression against anti-fascism in Maja’s case in Germany reached new, monstrous proportions overnight and just like that.

We demand the immediate return of Maja!
No more extraditions to Hungary!
